Before making a purchase on our website https://onshindosaka.com (the “Website”), it is extremely important to read and accept these Terms and Conditions, which establish the legal framework for purchases made on the Website.
Please review them carefully to find out about your rights and obligations. If these terms and conditions are not accepted no products will be sold, and Onshindo will not accept any responsibility.

1. Party responsible for the Website

This website is the property of Onshindo Biotechnology, S.L. (“Onshindo”) and offers Onshindo products to any consumer or end client (“Customer”). Therefore, you are entering into a contract with Onshindo Biotechnology, S.L., whose identification and contact details are:

2. Aim.

2.1. This contract regulates the purchase of products offered by Onshindo through their Website.

2.2. The products sold on the Website are exclusively for domestic use and private consumption. Onshindo may refuse any order that clearly does not constitute a retail sale. For that reason, sales will be limited to 6 units per reference number, and per Customer. Orders that don’t comply with these limits will be rejected.

2.3. Geographical Scope of Sales. Onshindo limits the sale and delivery of products exclusively to Customers located in the specific region for which the Website is intended, as clearly specified at the top of the Website. No sales or deliveries will be made to countries outside the geographical area designated on the Website.

2.4. In order to place a purchase order, the Customer must follow each of the
steps of the purchase procedure laid out on the Website.

3. Purchasing process.

3.1. To purchase products on the Website, the Customer must register as a registered user (or as a "guest"), filling in the form that appears on the Website at any given time and following the instructions indicated. If the Customer has registered as a user on the Website, for future purchases they will only have to enter their email address and password in the “Login” section.

3.2. Onshindo and the Customer will communicate via email. We recommend regularly checking the relevant email account for any important updates related to orders.

3.3. The price of the products will be that which is published on the Website. Prices will always include IVA. The price applying to the purchase order made by the Customer shall be the one stated at the moment these terms and conditions are accepted.

3.4. The delivery costs, which include customs duties and other charges related to delivery, are not included in the price of the products and shall be borne by the Customer, except in the case of orders with free delivery. These costs will be
detailed on the shopping cart page before the confirmation and finalisation of the order.

3.5. To buy the products, the Customer should add them to their cart, complete the order form and confirm the order. The confirmation of the order by the Customer implies the confirmation of the product purchase contract. In the absence of proof to the contrary, the data recorded by Onshindo constitutes proof of all transactions between Onshindo and the Customer. Onshindo will archive the electronic document which confirms this contract, and this will be made available.

3.6. In certain circumstances, Onshindo will offer gift wrapping of the products as an additional service. When placing the order the option “Order is a gift” will be available, and the Customer should select this specifically. This service is subject to an additional cost, which will be specified clearly when it comes to payment. If the order includes various products to gift wrap, they will be put together in one wrapped package. The specific details and conditions of this service will be laid out on the Website, giving the Customer all the information necessary to make a decision.

3.7. If the Customer has a discount code, they should enter it into the “Discount code” field on the order summary page to check that it is valid and in date. It is only possible to apply one discount code per purchase, and the code must be entered exactly, respecting any capital letters.
If the discount code is valid and in date, the corresponding discount will automatically be applied to the shopping cart.

3.8. After completing the purchase and paying for the products, Onshindo will send the Customer an email with the proof of purchase and a copy of these terms and conditions. The email will include essential details about the transaction:

● Assigned order number.
● Order summary, including product identification, quantity and price.
● Order total, with all the included taxes.
● Delivery costs.
● Details about the delivery process. This information will also be accessible in the Customer’s account on the Website, where the invoice corresponding to the order can be downloaded. The Customer should verify the accuracy of the information in the email as soon as
possible, and keep a copy for their records. If there are any discrepancies, the Customer has the right to request the correction of their details, or the cancellation of the order.

4. Payment for products.

4.1. The Customer will be able to pay for the products using one of the following payment methods:

● Debit/credit card: They will enter the number of their debit/credit card (Visa, Visa Electron and Mastercard) and the rest of the additional information required. The payment will be charged when it is accepted by the Customer financial institution. Otherwise, the purchase cannot be made.

If the POS reports that the card has been refused, the order will be automatically cancelled and the Customer will be informed of the cancellation online. For payments made with cards issued outside Spain, the issuing bank
must be a member of the Secure Electronic Commerce (CES) Security Protocol. Payments made with cards that do not fulfil this criteria will not be accepted.

● PayPal: The Customer will need a PayPal account to use this payment method. This payment method allows for payment without sharing financial information with Onshindo. The Customer will be redirected to the PayPal website, where they will enter their PayPal account credentials to accept the payment, and then return to the Website, where the order will be confirmed. Once the order confirmation has been received, PayPal will not allow the delivery address to be modified.

● Apple Pay: Customers who have this payment method will also be able to use it to pay for their purchases.

● Google Pay: This payment service is available to Customers authorised to use it.

4.2. The Customer is responsible for ensuring the accuracy of the information about their payment method. Onshindo is not responsible for any loss that the Customer might suffer as a result of providing incorrect payment information.

4.3. For any questions or requests about invoicing, please contact our Customer Care department.

5. Delivery and cancellation of orders.

5.1. Availability of products. Orders are subject to availability. If there is no stock available, Onshindo will inform the Customer by email, offering them a product with similar characteristics. The Customer will be able to accept the alternative offered by Onshindo or cancel their order fully or partially. If the order is cancelled, Onshindo will refund the order total to the Customer using the original payment method. If there is no response from the Customer within five (5) days from the date of notification, Onshindo will assume that the offer has been rejected. In this case, if there are other products in the order, they will be sent to the Customer.

5.2. Order cancellation. The Customer can cancel their order before it has been shipped by sending an email to customer_care@onshindosaka.com. The cancellation request should include the Customer’s name, address and the order reference number.¡

5.3. Delivery process. After confirming payment, Onshindo will prepare the order to be sent to the address provided. Onshindo will inform the Customer, through an email, of the date that the purchased products are sent, and the contact details of the transport company that will deliver the package. Onshindo shall not be liable for any errors and/or damages caused during delivery
if the customer has provided an incorrect or non-existent delivery address.

5.4. Delivery time. Orders will be delivered during standard working hours and within the estimated delivery period detailed on the Website, which will never be more than fifteen (15) days after the date of the Customer payment. We recommend the Customer check the Website to view the latest updates, with the estimated delivery date of each product. Items will be considered to have been
delivered from the moment at which the product is made available to the Customer.

Onshindo will inform the Customer if there are any issues with the delivery of the products.

5.5. Absence at the time of delivery. If the Customer is absent or no one collects the product(s) at the time of delivery, the Customer should contact Onshindo as soon as possible to arrange a new delivery date. When failure to deliver is not attributable to Onshindo or the delivery company, the products shall be returned to Onshindo and the Customer shall cover the shipping and return costs, as well as any associated handling fees.

5.7. Receipt and verification. For the order to be handed over, the Customer orperson accepting the order should show the courier a form of identification.

At the moment of delivery, the Customer or person accepting the order should check the status of the products. Any issues (incorrect, damaged or missing products) should be indicated on the delivery note and Onshindo should be informed immediately through an email sent to customer_care@onshindosaka.com, explaining the incident in detail and including photos where necessary. Onshindo will respond to said email providing an incident tracking number, and will
resolve the situation as soon as possible.

5.8. Risk associated with the products (including, but not limited to, loss, damage or theft) shall be transferred to the Customer as soon as the products have been made available to the Customer.

6. Right to withdraw.

6.1. The Customer has a period of fourteen (14) calendar days from the date the order is received to exercise their right to withdraw, as set out below. If the same order contains several products and these are delivered separately, the withdrawal period shall end 14 calendar days after the day on which the last of the purchased products was delivered.

If the order is made up of several components or items, the withdrawal period shall end 14 calendar days after the day on which the last of the components or materials was delivered. If the Customer has agreed to the periodic delivery of goods over a fixed period, the withdrawal period will end 14 calendar days after the day on which the Customer receives the first of these goods.

6.2. However, when the products are cosmetics, for reasons of hygiene, it will not be possible to return them when they have been opened/unsealed by the Customer. Therefore, once a cosmetic has been opened and/or unsealed, the Customer will not be able to exercise their right to withdraw in relation to that
product.

6.3. The Customer can exercise their right to withdraw by sending an email to customer_care@onshindosaka.com:
● unequivocally stating their decision to withdraw from the contract for the purchase of the products, or
● by sending the withdrawal form, which is Anexo 1 of these Terms and Conditions. This form is a template and Customers that wish to withdraw are
not obliged to use it.

6.4. The right to withdraw shall be understood to have been exercised within the established time limit when the communication is sent before the end of said time limit, in accordance with the aforementioned terms.

6.5. If the Customer exercises their right to withdraw, Onshindo will refund all payments received, including the costs of delivery, provided the Customer chooses the most economical delivery option. If they choose a more expensive delivery option, the additional costs incurred will not be refunded.

6.6. The amount will be refunded to the same payment card used for the purchase, within 14 calendar days from the date of the notification of the desire to cancel said purchase. However, reimbursement may be withheld until the goods have been received, or until the Customer provides proof that the products have been returned.

6.7. The Customer must return the products concerned within 14 calendar days.

6.8. The Customer shall only cover the direct costs of returning the products as a result of exercising their right to withdraw. Exercising this right does not involve any
additional cost.

6.9. In all cases, the products to be returned must be in perfect condition and with the manuals, accessories or gifts, cheques, vouchers, coupons, or any kind of promotional advantages, if applicable, included.

6:10. The Customer shall only be liable for any diminution in the value of the goods resulting from their handling, other than that which is necessary to establish their nature, characteristics or function. If the product is returned without its original packaging, the value of the product will be affected.

6:11. In the case of promotions in which several independent articles are purchased as part of the same pack (50% off the second unit, 2 for 1 or similar), the withdrawal will affect all the products included in the promotion.

7. Guarantee of compliance.

7.1. The guarantee of the products sold on the Website will comply with the provisions set out in the applicable legislation.

7.2. In general, Onshindo shall be liable for any non-compliance declared by the Customer within three (3) years of delivery of the products.

7.3. If the product sold is not compliant, the Customer may choose between replacement of the product or, alternatively, between a price reduction or termination of the contractual relationship in accordance with the applicable legislation. Onshindo shall bear the cost of returning non-compliant products.

7.4. The products shall be deemed to be compliant and, therefore, any damage shall not be covered by this guarantee, when:

a) Damage or deterioration of the products is caused by reasons beyond Onshindo's control, or as a consequence of incorrect use by the Customer, per the instructions for use provided.

b) Damage or deterioration to the products is caused by or originates from a
component not supplied by Onshindo.

8. User obligations.

8.1. The Customer can only buy the products sold on the Website if they are over 18 years old.


8.2. In order to purchase the products offered on the Website, the Customer must accept and comply with this contract, and pay the sale price and any associated costs necessary for the delivery of the product.


8.3. The registered Customer will use the Website by accessing their personal account, with their email address and password. The password and
user name may not be used by anyone other than the Customer. The Customer shall be responsible for keeping their username and password
secure. Please, never share your password or write it down anywhere. If the User detects any unauthorised use or any other breach of security of their account, they shall notify Onshindo immediately. As soon as they inform us of any unauthorised use of their username or password, we will take the necessary measures to prevent the use of this information. We will inform them of these steps and the reasons for them immediately after they have been taken, unless there are legal reasons preventing us from doing so. We shall not
be liable for any loss or damage arising from failure to comply with obligations under this clause.

8.4. The Customer accepts and guarantees that:

a) The information provided is true, accurate, up-to-date and complete.

b) They shall not use the contents and information on the website to send advertising, to send messages for any other commercial purpose, or to
collect or store personal data of third parties.

c) They will not use the Website for any purpose that is unlawful, impermissible or in breach of this agreement or the information published on the Website. Specifically, they will not use the Website: (i) for any purpose other than the purchase of the products offered; (ii) using
automated systems; (iii) to disrupt the activity of third parties; (iv) in a way that interrupts, destroys or limits the functionality of computer software or
hardware or telecommunications equipment; (v) to hinder or interfere with the use of the Website; (vi) to infringe the rights of third parties, or (vii) for
any purpose comparable to those listed above.

9. Security.

Our Shopify shop is PCI Level 1 compliant for the payment card industry and is certified by 256-bit SSL encryption - a method used to encrypt and decrypt data transferred between the user's browser and the web server.

10. Customer care.

10.1. The Customer can submit complaints by sending an email to customer_care@onshindosaka.com. In the email, the Customer shall state the purpose of their request and the reasons for it, indicating the solution they propose. Onshindo Customer Care will deal with the complaint impartially, trying to resolve it as soon as possible. The maximum period for resolving complaints and claims submitted shall be one (1) month from their submission.

10.2. If the Customer request is rejected by Customer Care or if a period of one (1) month elapses without a response, the Customer may file a complaint on the dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr.

11. Data protection.

The Customer personal data will be processed per our Privacy Policy available at this link, after the express acceptance of the Customer.

12. Applicable law and jurisdiction.

12.1. These terms and conditions shall be governed by the laws of the country or region to which the Website is addressed, as indicated at the top of the Website.

12.2. The competent Courts and Tribunals in accordance with the applicable legislation will settle any conflict between Onshindo and the Customers. Alternatively, Onshindo and the Customers may expressly agree to submit to
Consumer Arbitration.
